LYNDEN TOWNSHIP ORDINANCE NO. 2009-1
Summary for Publication

An Ordinance amending Zoning and Land Use Ordinance 2.1 within Lynden Township.

WHEREAS, the Lynden Township Board of Supervisors instituted proceedings to adopt Lynden Township Ordinance 2009-1; and,

WHEREAS, on January 2, 2009, Notice of Public Hearing and intent to adopt Lynden Township Ordinance 2009-1 was published in the official newspaper of the town; and,

WHEREAS, on January 12, 2009, the Lynden Township Board of Supervisors held a public hearing to consider the proposed ordinance; and,

WHEREAS, on January 26, 2009, the Lynden Township Board of Supervisors approved the Ordinance 2009-1 amending Ordinance2.1; and,

NOW PURSUANT TO THE AUTHORITY VESTED BY MINNESOTA STATUTES SECTION 462.16, THE LYNDEN TOWNSHIP BOARD OF SUPERVISORS ORDAINS:

The following is a summary of the amendments to Zoning and Land Use Ordinance 2.1 adopted by Lynden Township as Ordinance 2009-1.

Adds 3.2.216 A - Definition of Viewshed

Amend Section 6.1
Add A construction site permit is required for all agricultural accessory structures in Lynden Township greater then 120 square feet.

Amend Section 6.51.3 A-Table (Wind Energy Conversion Systems, WECS)
Requires Conditional use permits for WECS 5.99kw or less if the height of WECS exceeds 40 feet on residential parcels and in Shoreland and requires WECS of 6kw -40 kw in Shoreland Overlay District to be Conditional Use permit.

Add to 6.51.4 A, the following sentence: Guy wires shall be subject to the setback requirements.

Add Section 6.52 Alternative Energy, requires conditional use permits for structures greater than 15 square feet.

Add Section 8.3.1A. re-establishes in Lynden Township that residential plats approved before April 21, 2000 shall be zoned R-1 regardless of primary or underlying district. This section was removed from Stearns County Zoning Ordinance.


Interim Ordinance Number 2008-1 is repealed and Ordinance 2009-1 is enacted.

Ordinance 2009-1 is too lengthy to be published in its entirety. A complete copy of Ordinance 2009-1 is on file at the Township with the Town Clerk or can be viewed on Township website www.lyndentownship.org.

This ordinance is effective on the date publication.

SUBJECT: Depositing snow or ice in the right-of-way in Lynden Township, Stearns County, State of Minnesota

We have a heavier cover of snow this year than we have had in the past few years and some residents are having difficulty storing the snow from their driveways on their own properties. Particularly, in the more densely populated, platted subdivisions, there is little room for snow from a heavy snowfall.

Snow piled in the right-of-ways creates real hazards for motorists as well as snow removal crews and equipment. The Board reminds citizens of the dangers and liabilities of pushing snow from the driveways into the Township right-of-way:

Minn. Stat. § 160.27, subd. 5, it is a misdemeanor to deposit snow or ice in a road right-of-way. The law also considers it littering to place snow or ice in a right-of-way, which is punishable as a misdemeanor.

Minn. Stat. § 169.42, subd. 1 & 5.
If an owner or occupant continually violates these prohibitions, in addition to the cost recovery procedures, the legislature made available within Minn. Stat. § 366.016, the board can also consider contacting the sheriff’s department for possible action under the criminal statutes.

The Board asks the cooperation of the residents in ensuring the safety of both the traveling public and the snow removal equipment by finding room to store snow within the property boundaries.

The Interim Ordinance enacts a Moratorium on the establishment of Wind Energy Conversion Systems on residentially platted parcels within Lynden Township for 6 months to study and review its Comprehensive Plan and Ordinances to determine what changes, if any may be required in the regulation of Wind Energy Conversion Systems, to ensure proper land use controls, and to facilitate compatibility between such property and the surrounding property.

FINDINGS AND ORDER

In the Matter of Hazardous Real Estate located at 3022 Fulton Circle in Lynden Township, Stearns County, Minnesota, legally described as follows:

3022 Fulton Circle, Lynden Township, Stearns County, Minnesota. Full legal description attached as Exhibit A hereto.

To: The property owner and all others claiming any right, title or interest in the above-described real property:

1. Pursuant to Minnesota Statutes §463.15 et seq., the Lynden Town Board , having duly considered the matter, finds the above-described property to be a hazardous building for the following reasons:

a. The burned out remains of a manufactured home poses a hazard to the public. Portions of the walls, roof and floor assemblies have collapsed and/or have been burned. All electrical, plumbing and heating systems have been destroyed, and the structure is not structurally sound enough to support foot traffic.


2. Pursuant to the foregoing findings and in accordance with Minnesota Statutes §463.15 through §463.261, the Town Board hereby orders the record owners of the above-described hazardous building to take the following actions, or cause the same to occur:

a. raze and remove the building within thirty 30 days of service of this Order.

b. cause any resulting excavation to be filled to grade within said period.

c. obtain all necessary demolition or other permits as may be required by state agencies or local units of government prior to performing the work required hereunder.

d. cap all wells, as may be required, in accordance with state or local laws and regulations.

e. remove or collapse any septic system, as may be required, in accordance with state or local laws and regulations.

f. comply with all applicable state and local laws and regulations in performing the work as required hereunder.


The Town Board further orders that all personal property or fixtures shall be removed from the building within thirty (30) days of service of this Order and, if not so removed, the Lynden Township may remove and sell such personal property or fixtures at public auction as required by law.

3. The Town Board further orders that unless the above-listed actions are taken or an answer is served upon the Lynden Township and filed with the Office of the Clerk of Court of District Court of Stearns County within twenty (20) days from the date of service of this Order, a motion for summary enforcement of this Order will be made to the District Court of Stearns County.

4. The Town Board further orders that if the Town is compelled to take any corrective action as herein provided, all necessary and allowable costs expended by the Town may be assessed or become a lien against the above-described real property and be collected as provided by law.

5. The Town Board Chair, Town Clerk, Town Attorney and other officers, agents and employees of the Town are authorized and directed to take such action, prepare, sign, and serve such papers as are necessary to enforce this Order and to collect the costs thereof, or seek such other relief, in any manner as may be provided by law.

Lynden Township Board of Supervisors will hold a public hearing on June 5, 2007 at 7:15 PM At the Lynden Township Hall to consider amending portions of Lynden Township Subdivision Ordinance 3.1 as Ordinance 3.2. The intent of the amendments is to clarify the subdivision process and correct any typographical or grammatical errors throughout the Ordinance. Amend Appendix B, Lynden Township Road Standards to specify design and construction specifications, drainage and erosion standards and engineering and maintenance standards to include illustrated Road Cross Sections for Residential and Commercial-Industrial Roads.
